Should I enter into a prenuptial agreement?

Engaged couples in Juneau often have a lot on their plates, from wedding planning to buy a home. As they look excitedly into the future, the last thing they may want to do is consider what will happen if their marriage ends. However, discussing that possibility is important, as is deciding whether to enter into a prenuptial agreement.

What is a prenup?

A prenuptial agreement, also known as a prenup, is a written contract that a couple creates before they marry. The agreement essentially addresses many issues that arise upon divorce including:

  • Property division
  • Alimony/spousal support
  • Spousal responsibilities
  • Provisions to protect the rights of children from previous relationships

While you can address many issues relating to a divorce in a prenup, child custody and child support should not be included. The court will make child custody and support determinations during the divorce process by determining the best interests of the child.

Why do I need a prenup?

It can be hard to think about your marriage ending before it even begins. However, the reality is that even the happiest relationships do not necessarily last forever. A prenup can make the divorce process much easier by saving you time and money.

A prenup can allow you to finalize your divorce quickly and help you avoid going back and forth with your ex in court. If you are trying to decide whether to enter into a prenuptial agreement, consider speaking to an attorney who specializes in family law matters.
